CLARIFICATION TEXT OF THE LAW ON THE PROTECTION OF PERSONAL DATA
Dear Patients and Guests,
This clarification text has been prepared by Op. Dr. Esra Çabuk Cömert, who operates a private medical care practice at Beştepe Mahallesi Yaşam Caddesi No:13/A 82, in the capacity of data controller within the scope of the "Data Controller's Obligation to Inform" in Article 10 of the Personal Data Protection Law No. 6698 ("KVKK").
In accordance with the KVKK and other relevant legislation, your personal data, especially your medical data, can be processed within the limits described below and may also be shared with third parties within these limits. Below, which personal data is processed, for what purpose personal data is processed, the method and legal reason for collecting personal data, to whom and for what purpose the processed personal data can be transferred, and your rights against the data controller, i.e. Op. Dr. Esra Çabuk Cömert are explained. We kindly ask you to read it carefully.
1.Personal Data Processed
In accordance with Article 3 of the KVKK, "personal data" belongs to our patients, guests or other third parties:
Identity data: Name, surname, mother/father name, Turkish ID number and/or passport number, place and/or date of birth, marital status, gender, occupation, workplace registration and/or patient identification number and other identification data;
Contact data: Address, phone number, e-mail address;
Operational data: Personal data obtained when the practice is contacted via voice call records kept by customer representatives and / or patient services in accordance with call center standards and electronic mail, letter and / or other means, data on private health insurance for the purpose of financing and planning of health services and data on payer institution information such as Social Security Institution, health insurance, insurance card number, bank account number, IBAN number, credit card information, billing and billing information, surveys, thank you, complaint letters, notifications such as satisfaction results;
Medical data: All kinds of health, medical data, including all kinds of patient medical reports, diagnostic data, laboratory results, all kinds of medical test results, examination data, doctor's analysis and comments, appointment information, prescription information, including, but not limited to, information obtained during and/or as a result of medical diagnosis, treatment and care services;
Operation security: Data sent through Op. Dr. Esra Çabuk Cömert's website (https://www.esracabukcomert.com), website traffic information (website login and exit information, IP address you use, page information you access) and data obtained from cookies, etc;
Physical venue security: Entry and exit registration information of visitors, camera recordings that are constantly recorded in public areas for security purposes;
refers to any information relating to an identified or identifiable natural person, including but not limited to health, medical data indicated above, obtained directly or indirectly and in any way (including but not limited to written, verbal, visual, electronic, magnetic or digital forms) by Op. Dr. Esra Çabuk Cömert or her employees, performance assistants.
Pursuant to Article 6 of the KVKK, "sensitive personal data" means, among personal data, data relating to race, ethnic origin, political opinions, philosophical beliefs, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, and biometric and genetic data.
Pursuant to Article 3 of the KVKK, "processing of personal data" means any operation performed on personal data such as obtaining, recording, storing, retaining, modifying, reorganizing, disclosing, transferring, taking over, making available, classifying or preventing the use of personal data by fully or partially automatic means or by non-automatic means provided that it is part of any data recording system.
Pursuant to Article 3 of the KVKK, "data subject" refers to the natural person whose personal data is processed.
Your personal data and your sensitive personal data among them can be processed by Op. Dr. Esra Çabuk Cömert in connection with the purposes specified below and in a measured manner, and can be transferred to the persons, institutions and organizations specified below.
1.Purposes of Processing of Personal Data
Your personal data may be processed by Op. Dr. Esra Çabuk Cömert for the following purposes:
To fulfill our legal obligations under the Medical Services Basic Law No. 3359, the Law No. 6698 on the Protection of Personal Data, the Regulation on Personal Medical Data and other relevant legislation,
Protection of public health, preventive medicine, medical diagnosis, treatment, control and care services, planning and management of health services and financing,
Provision of customized medicines and/or medical supplies and/or devices,
If you make an appointment, informing you about the appointment, providing information and/or reminding you of the appointment,
Sharing and responding to information obtained with the Ministry of Health and other public institutions and organizations in accordance with the legislation,
Inquiring your entitlement with the institutions/organizations contracted with Op. Dr. Esra Çabuk Cömert or financial reconciliation with these institutions regarding the health services provided to you,
Sharing and authenticating information requested by contracted institutions/organizations, especially private insurance companies, within the scope of financing health services,
Issuing an invoice in exchange for the services we offer,
Analyze your use of health services and store your health data in order to develop and improve the health services we provide to you, and respond to your questions or complaints about our services,
Providing the necessary information in line with the requests and audits of regulatory and supervisory institutions and official authorities,
To keep the information related to your health data which should be kept in accordance with the relevant legislation,
Measuring patient satisfaction after receiving health services and increasing patient satisfaction,
Measuring and auditing the quality of service during phone calls,
Ensuring the security of physical space,
Launching our website (https://www.esracabukcomert.com) and enhancing user experience,
Carrying out other activities that are expressly permitted by the legislation.
Your sensitive personal data, such as your health data, can only be processed without your explicit consent for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing.
Your personal data other than special categories of personal data may be processed without your explicit consent for the purposes listed above.
1.The Method of Collecting Personal Data and its Legal Reason
Your personal data may be collected verbally (such as verbal communication, telephone call), in writing (such as forms, test results, e-mail, fax, courier), visually, electronically, fully or partially automated or non-automated methods, including forms filled in electronically or in writing by you, transactions carried out for the purpose of carrying out medical diagnosis, treatment, control and care services.
The legal reason for collecting your personal data is that it is necessary for the fulfillment of contractual, legal and legal obligations by Op. Dr. Esra Çabuk Cömert and it is mandatory for the legitimate interests of Op. Dr. Esra Çabuk Cömert, provided that it does not harm the fundamental rights and freedoms of the person concerned.
1.To Whom and for What Purpose Personal Data May be Transferred
By ensuring that all necessary technical and administrative measures are taken to ensure the appropriate level of security in accordance with the KVKK and the relevant health legislation and for the same purposes as the purposes of processing the personal data listed above, your personal data may be sent to official authorities, especially the Ministry of Health, Provincial Health Directorate, public hospitals and private hospitals, polyclinics, laboratories, doctors, private insurance companies, banks, our doctors, other employees or consultants who assist us in the fulfillment of our contractual and legal obligations, natural or legal persons you specify with your verbal or written request, third parties, other natural or legal persons permitted by the legislation.
Your personal data related to health, which is counted among the personal data of special nature, can only be transferred to the real or legal persons listed above without seeking your explicit consent for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing.
1.Rights of the Person Concerned
In the capacity of the person concerned, you, our esteemed patients and guests, can contact Op. Dr. Esra Çabuk Cömert about yourself, you have the following rights:
To learn whether personal data is processed or not,
If personal data has been processed, requesting information about it,
To learn the purpose of processing the personal data and whether they are used in accordance with the purpose,
To know the third parties to whom personal data are transferred at home or abroad,
To request correction of the personal data in case of incomplete or incorrect processing and to request notification of the transactions carried out in this context to the third parties to whom the personal data are transferred,
To request the deletion or destruction of personal data within the framework of the conditions provided for in the KVVK and to request that the transactions carried out within this scope be notified to the third parties to whom the personal data are transferred,
To object to the emergence of a result to the detriment of the person himself/herself by analyzing the processed data exclusively through automated systems,
To request compensation of the damage in case of loss due to unlawful processing of personal data.
